Cisco Third Party Policy

“When a customer reports a product fault or defect and Cisco believes the fault or defect can be traced to the use of third-party memory products, cables, GBIC’s, filters, or other non-Cisco components by a customer or reseller, then, at Cisco’s discretion, Cisco may withhold support under warranty or a Cisco support program such as SMART Net Total care™ service.

When a product fault or defect occurs in the network, and Cisco concludes that the fault or defect is not attributable to the use of third-party memory, cables, GBICs, filters, or other non-Cisco components installed by a customer or reseller, Cisco will continue to provide support for the affected product under warranty or covered by a Cisco support program.

The nature of the defect or error is the key to determining Cisco support obligations.

Cisco will not void the warranty or SMART Net on the system because of the use of a third party component. We stand behind our products and will support any issue with a transceiver, cable, or memory module that we supply. All of our products come with a Lifetime Replacement Warranty and free standard overnight replacement*.

*Free standard overnight replacement after it has been determined by a member of the GigaTech Support Team that the item is defective and requires replacement, and only within the continguous 48 USA states.

“Will the OEM refuse support if I use a GigaTech compatible product?”

System manufacturers (OEM) cannot deny warranty or support of the system because of the use of third party transceivers or cables and official statements supporting this can be found on numerous system manufacturer websites. The reason for this is due to the Magnuson Moss Act, passed by the FTC in 1975, defined in Section 2302 Subsection C:

(c) Prohibition on conditions for written or implied warranty; waiver by Commission No warrantor of a consumer product may condition his written or implied warranty of such product on the consumer’s using, in connection with such product, any article or service (other than article or service provided without charge under the terms of the warranty) which is identified by brand, trade, or corporate name.

So, unless the system manufacturer wants to supply the accessory article at no cost to the consumer, they cannot limit the purchase of accessory goods to exclusive use of manufacturer originals. This does not mean that the system manufacturer has to warrant the accessory item or service purchased from a third party vendor, that responsibility falls upon the company that has supplied the accessory or service.
